The images on our site must have a license for use and all of your use of images from this site must comply with the license you have been given. Violations will be pursued to the fullest extent. WHO OWNS COPYRIGHT?

We know it can be confusing – you have paid for photographs so you own them completely, right?

Well… no. When you engage my services (or the services of any other professional photographer) you are hiring my time, my expertise, my skill and a license to use a certain number of images that I have produced.

As a matter of law, in the UK, the copyright to the images created by a photographer stay with that photographer (or their estate) up to 70 years after they die. This is because the photographs we create are our intellectual property.

BUT DO YOU EVEN NEED COPYRIGHT?

In the overwhelming majority of cases, the answer to this is no.

Here is a quick test:

  1. Are you a celebrity who is concerned their images will be used by the media?
  2. Do you plan on selling your wedding photographs for profit?
  3. Do you plan on using your wedding photographs commercially for things such as print advertisements or website stock imagery?
  4. Do you plan on selling copies of your wedding photographs on products such as t-shirts, keychains and novelty hats?
  5. Do you plan on opening a wedding photography business and passing your wedding photographs off as photos you have taken? 

If you answered yes to any of these questions, you will likely need a commercial use license. If you answered yes to questions 1 or 5, you will probably need copyright.

For everyone else – you don’t need copyright. You need a license to privately use, print and redistribute. Good news is that you will already have that when you hire us to provide you with wedding or family photography. If you have hired us for commercial photography, you will have a pre-negotiated commercial use license.

  • Your name, full address & contact details.
  • The image you are interested in.
  • The purpose you would like to use the image for (please be very specific).
  • The expected distribution (one time printing, worldwide, etc.)
  • The length of use/distribution.

All copyright, trademark, and other intellectual property rights on this site, are the property of Eneka Stewart Photography.

No permission, either express or implied, is granted for the electronic transmission, storage, retrieval, or printing of the photographs contained on tuxandtalesphotography.co.uk (and related domains) and any other sites displaying photographs by Eneka Stewart Photography, other than that which is related to the normal “caching” practices of web browsers.

No parties/individuals visiting or viewing images from tuxandtalesphotography.co.uk and any other sites displaying photographs by Eneka Stewart Photography, may otherwise copy, modify, publish, transmit, or distribute the contents of the photographs found herein. Express written permission must be granted, on behalf of the photographer (copyright holder, Eneka Stewart Photography), in order to use these photographs for any purpose that is not outlined above.

Reproduction rights (if and when granted) are strictly limited to the use specified on the license you receive and only once final payment has been taken in cleared funds. An agreement must be reached with Eneka Stewart Photography before the images are used for a different purpose or after the duration license has expired. Eneka Stewart Photography reserves the right to charge a penalty fee of £100 per image per use (in addition to the customary charge) if images are used for purposes other than what is shown on the license you hold.

All original digital files created by Eneka Stewart Photography remain the property of the Eneka Stewart Photography.

FAQs

Who can use the images?

You (and anyone you give access to your image gallery) may use your images for personal (non-commercial) use.

Do I need to tag you on social media?

Please tag us on all social media (@enekastewart) and any place where our work appears in print or on the internet should be attributed to Eneka Stewart Photography.
Please note that tagging an image does not alleviate the responsibility of limiting the use of the image to the purposes stated in your license.

How can I use my images?

You can have them printed by a printer of your choice (although we do strongly recommend our professional printing services). You can make secondary items from your images (thank you cards, mugs, t-shirt, keychains, etc.) that you give away but not ones that you sell. You can display your images in a private setting (your home is a private setting – a public shop is not). You can share your images on Social Media with the appropriate attribution (we can be found @enekastewart in most places but please e-mail if you need specifics).

Is there anything I cannot do with my images?

You may not sell your images to anyone else. You may not give your images to anyone who will be using them for commercial purposes (use by other wedding vendors is a commercial purpose as they are used to promote their business). You may not sell reproductions or secondary items made wholly or partially from our images. You may not alter the images in any way including application of filters or effects. You may not use your images to disparage us or our work. You may not use your images with a representation that they were taken by anyone other than Eneka Stewart Photography. You may not have your images displayed in a magazine, blog or newspaper not directly affiliated with Eneka Stewart Photography. For all of these purposes, you must contact us for a commercial use license or exemption statement.

What if a vendor wants to use my images?

A vendor’s use of images taken by Eneka Stewart Photography is a commercial use and they need to contact us directly to obtain a commercial use license. We will extend this license at our discretion and may opt to levy a fee for this license. Do not distribute your images to any of your wedding vendors directly – doing so will incur a £100 penalty fee (in addition to our customary charge) per image per use.

But XYZ photographer gives copyright to their images, why won’t you?

All I can say is that if copyright is something you want, but you don’t want to pay for it – then hire XYZ photographer. Not my circus, not my monkeys. The wedding photography world is tiny and we all pretty much know one another. No professional wedding photographer that I know will give copyright as a matter of course. If someone is giving copyright as standard, this should inspire a lot of questions…

What if I have accidentally used one of your images without your permission?

Please remove the image and contact us ASAP – info@enekastewart.com At our discretion, we will levy a £100 penalty fee per image per use (in addition to our customary charge).
